[플러스코리아 이형주 기자] 한국시간 31일 평소 경제적 어려움 호소하던 삼성전자서비스 30대 협력업체 직원이 “전태일처럼 못해도 선택했다”는 카카오톡 메시지를 동료에게 남기고 스스로 목숨을 끊자 노조가 “삼성의 탄압이 죽음을 불렀다”라고 주장하고 있어 삼성의 기업행태가 다시 수면 위로 떠오르고 있는 가운데 지난 23일의 AP 통신 기사가 다시 주목을 끌고 있다.
AP 통신은 지난 18일 서울행정법원 행정합의 1부(부장 이승택)가 2009년 백혈병으로 사망한 삼성전자 전 직원 김경미씨의 유족이 유족급여 등을 지급하라며 근로복지공단을 상대로 낸 소송에서 원고 승소한 판결 소식을 23일 전 세계에 타전했다. AP 통신은 ‘법원: 조사가 삼성의 건강 유해물질을 과소평가했다-Court: Studies understated Samsung health hazards’라는 제목의 기사에서 ‘한국의 재판부는 삼성반도체 공장들에 대해 안전도를 파악하기 위한 자체조사가 작업환경의 건강 유해물질을 제대로 조사하지 못했다고 말했으며, 이는 그동안 반도체계의 거대기업이 자기들의 생산공장이 치명적인 암을 유발시켰다는 비난으로부터 책임을 회피하려 한 노력을 훼손시키는 것이었다’라고 전했다.

SEOUL, South Korea (AP) -- A South Korean court said studies conducted to e-valuate safety at Samsung chip factories failed to fully examine workplace health hazards, undermining the electronics giants efforts to distance itself from claims that its manufacturing plants caused fatal cancers.
한국의 재판부는 삼성반도체 공장들에 대해 안전도를 파악하기 위한 자체조사가 작업환경의 건강 유해물질을 제대로 조사하지 못했다고 말했으며, 이는 그동안 반도체계의 거대기업이 자기들의 생산공장이 치명적인 암을 유발시켰다는 비난으로부터 책임을 회피하려 한 노력을 훼손시키는 것이었다.
The finding by the Seoul Administrative Court was part of a ruling in the case of a Samsung Electronics Co. worker who died of leukemia in 2009 at age 29.
서울행정법원의 이 말은 2009년 스물 아홉의 나이로 백혈병에 걸려 사망한 삼성전자 근로자의 승소판결의 일부이다.
A panel of three judges said Friday that a "considerable causal relationship" existed between Kim Kyung-mis leukemia and her five years of work at a Samsung memory chip factory, dipping wafers in chemicals.
세 명의 판사로 이루어진 재판부는 금요일, 김경미씨의 백혈병과 김씨가 삼성반도체 공장에서 웨이퍼를 화학물질에 담그는 일을 오년 동안 해온 사실 사이에 "상당한 인과관계"가 있다고 말했다.
The judges said Kim must have been exposed to more toxic chemicals than safety studies said existed at Samsungs factories.
재판부는, 삼성공장에 대한 자체안전검사를 통해 조사한 결과보다 더 많은 독성 화학물질에 김씨가 노출된 것으로 보인다고 말했다.
Samsung, one of the best known South Korean companies and a powerful force in the countrys economy, has cited studies that found no dangerous level of benzene, formaldehyde or other carcinogens to ease public concerns about workplace hazards.
가장 잘 알려진 한국의 기업 중 하나이며 국가경제의 막강한 세력인 삼성은 작업환경의 위험에 대한 대중의 염려를 잠재우기 위해 위험량의 벤젠, 포름알데히드, 혹은 다른 발암물질을 전혀 발견하지 못했다고 하는 자체조사 결과를 언급해왔다.
But the studies did not e-valuate exposure to chemicals during maintenance work, blackouts, gas leaks or other incidents when the level of toxic gas goes up sharply, the judges said. The court ordered the Korea Workers Compensations &Welfare Service, a government agency, to pay compensation to Kims family.
그러나 이 조사는 보수공사, 정전, 가스누출, 혹은 그외 사고 시에 유독가스가 급격히 상승하는 경우의 화학물질 노출도를 조사에 포함시키지 않았다고 재판부는 말했다. 재판부는 정부기관인 한국근로복지공단이 보상금을 김씨 가족에게 지불하라고 판결했다.
Claims for compensation for injuries and disease linked to the workplace are decided by the agency, which levies companies to fund its payouts. The agency had previously denied compensation to Kims family who appealed to the Seoul court.
작업현장에서 얻은 부상이나 질병에 따른 보상청구는 근로복지공단이 결정해 회사측에 보상금을 부과한다. 근로복지공단은 이전에 김씨의 가족에게 보상금 지불거부를 결정했었고, 가족들은 서울지방법원에 소송을 제기했다.
The latest ruling is the second case in South Korea in which a court recognized a link between leukemia and working conditions at Samsung memory chip factories.In 2011, a court said the deaths of two Samsung workers from leukemia were associated with their work at the company and ordered the government agency to pay compensation to their families. The agency appealed and the case is pending.
이번 판결은 법원이 삼성 반도체 공장의 근로조건이 백혈병과 관련이 있음을 인정한 두번째의 판결이다. 지난 2011년 법원은 백혈병으로 사망한 두 명의 삼성 근로자들의 사인이 근무환경과 관련이 있다며 근로복지공단에 대해 유족들에게 배상할 것을 명령했다. 이에 공단은 항소해 현재 계류중이다.
Kim worked at Samsungs chip factory in Giheung between 1999 and 2004 on "Line 2", which was one of the three oldest chip manufacturing lines at Samsung. The two other workers who died of leukemia and won compensation from the government agency worked on these three lines, all of which were built during the 1980s.
김경미씨는 지난 1999년으로부터 2004년까지 기흥의 삼성반도체 생산공장에서 가장 노후화된 세 곳의 생산라인 가운데 하나인 ‘2 라인’에서 근무했다. 백혈병으로 사망하고 근로복지공단으로부터 보상을 판정 받은 두 명의 근로자들도 1980년대 준공된 이 세 라인에서 일했다.
Lee Jong-ran, an attorney who helps tech industry workers, said most leukemia deaths of Samsung worker were among employees who worked at the old lines. They were shut and renovated after 2006.
첨단기술 산업 근로자들을 돕고 있는 이정란 변호사에 따르면 백혈병 사망자 대부분이 노후화된 이곳 라인에서 일했다고 한다. 이 곳은 2006년 이후 폐쇄되었고 보수에 들어갔다.
The judges said there was a "high probability" that benzene, formaldehyde or other leukemia-causing materials were contained in the chemicals Kim used, or created during the manufacturing process.
재판부는 벤젠, 포름알데히드 또는 다른 백혈병 유발 물질들이 김씨가 사용한 화학약품에 포함되어 있거나 또는 제조과정에서 생성되었을 “높은 개연성”이 있다고 말했다.
But it said it was not possible to further determine Kims exposure to carcinogens partly because Samsung hadnt cooperated.

"Samsung Electronics, which did not preserve information of chemical materials used during Kims work and did not disclose some data citing trade secrets, is partly a cause," the ruling said.

Samsung was not a defendant in Kims case.

"While the courts decision appears to have been based on probability, as a party that was not a part of the proceedings, we feel that it would be inappropriate for us to comment on the matter," Samsung said in a statement. "Regardless, Samsungs top priority has always been ensuring the health and safety of every person we employ."
